High Court decision on Airport Services Input Methodologies merits review

Auckland Airport advises that it has received the High Court’s decision on the merits review appeal of the Commerce Commission’s Airport Services Input Methodologies (IM Review 2023) Amendment Determination. The merits review appeal, filed by the New Zealand Airports Association and Auckland, Wellington and Christchurch International Airports, was in relation to the cost of capital.

The High Court has declined the appeals lodged by the airports. Auckland Airport is now considering the findings of this judgment.

Auckland Airport expects that the Commerce Commission, in accordance with its commitment to the Court, will now consult on amendments in relation to coding errors conceded by the Commission. The process is expected to take place during 2026.

Separately, Air New Zealand and Qantas have appealed the High Court’s decision on their recent judicial review application that sought to quash the 2023 IM Determination. Auckland Airport is awaiting further information on when this matter will be heard.

Auckland Airport understands the High Court judgment will be released on its website later today.
